About these terms
These terms apply to your use of kahwat.com and to services provided by Kahwat.com ("we", "us"), based in Kashmir, India. By using the website or our services you agree to them. When we work together, your written proposal or agreement sets out the scope, fees and timelines; if it differs from these terms, the proposal or agreement applies. Questions can be sent to hello@kahwat.com.
Using this website
- The website, including our guides, is for general information. It is not professional, legal or financial advice for your specific situation.
- We work to keep it accurate and current, but we do not guarantee that every detail is complete or up to date.
- Please don't misuse the website: for example by sending spam through our forms, trying to access parts of it you aren't meant to, or copying it in bulk.
Our services
We provide marketing, sales and operations services, including performance marketing, sales funnels, websites, custom CRM, AI agents and automation, custom software and mobile apps. What we deliver, when, and for what fee is agreed in writing before work starts.
Monthly plans
- Monthly plans are billed at the start of each month, for the month ahead.
- You can cancel at any time with 30 days' written notice. There is no minimum term.
- A billing month that has started is not refunded. Full details are in our Refund Policy.
- Ad spend is separate from our fees. You pay it directly to the ad platforms, from ad accounts your business owns.
Your part
- Give us accurate information, and the access and approvals the work needs, in good time.
- Make sure you have the right to use the content you give us, such as logos, photos and text.
- Follow the laws and platform rules that apply to your business and your marketing, including those of Google, Meta and WhatsApp.
Delays in information, access or approvals can move timelines.
Payment
Invoices are due as set out in your proposal. We may pause work while an invoice is overdue, and resume once it is paid.
Who owns the work
- Content and materials you give us remain yours.
- Unless your proposal says otherwise, the work we create for you becomes yours once it has been paid for in full.
- We keep ownership of our general tools, methods and know-how that existed before your project or that are not specific to it, and may continue to use them in other work.
- We won't name you as a client, or show your project publicly, without your permission.
Confidentiality
We keep your business information confidential and use it only to provide our services. How we handle personal data is explained in our Privacy Policy.
Other platforms
Much of our work runs on platforms owned by other companies, such as Google, Meta, WhatsApp, app stores and hosting providers. Their own terms apply, and we can't control their decisions, outages or policy changes, such as an ad being rejected or an account being restricted. We will help you respond when that happens.
Results
We build and run marketing, sales and operations systems carefully and report on them honestly, but results depend on your market, your offer and many things outside our control. We do not guarantee specific rankings, leads, sales or revenue.
Liability
To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits, and our total liability for any claim is limited to the fees you paid us for the service the claim relates to. Nothing in these terms limits any right you have that cannot be limited by law.
Courses
- Course fees are non-refundable once paid, as set out in our Refund Policy.
- Course materials and recordings are for your own learning. Please don't share, resell or publish them without our permission.
Governing law
These terms are governed by the laws of India, and disputes are subject to the jurisdiction of the courts of Jammu and Kashmir.
Changes to these terms
We may update these terms. The date at the top shows when they last changed. The version in force when you agreed to a service applies to that service.
